ckEditor is adding a <p> -Tag

Hello guys,
I have the problem, that the CKEditor is adding a <p> </p> around my section-items of my xml.
here: my webpage: <?xml version="1.0" encoding="UTF-8"?> <MyCoReWebPage>
<section xml:lang="all">
--NORMAL HTML-CONENT--
</section> </MyCoReWebPage>
when i edit some of the content the CKEditor adds a p-Tag around my html-Content and my web software can't handle that.
How can I provide adding a p-Tag inner a section?

Update: I just testet it with the newest version of CKEditor (4.2.2) and now its deleting all my htlm-tags and still adding a p-tag around my section-content.

CKEditor is not an XML editor. It works on HTML. This makes this ticket invalid.
