I can't reproduce this in CKEditor 4.4.7 and native IE10. I'm initializing editor with your list, I'm putting cursor at the end of list and press enter twice. Cursor leaves list as expected.
If cursor is put not at the end (there are characters after it) new items will be created which is correct (I will add that it works just like in MS Word).
@a.delura could you recheck - perhaps there are some details you have forgotten to mention.
